Please read these terms carefully before using our boat lift installation services. By engaging with Boat Lift Installation of Georgetown, MD, you agree to be bound by these terms and conditions.


1. Service Agreement Overview

Boat Lift Installation of Georgetown, MD ("Company," "we," "our," or "us") provides professional boat lift installation, inspection, maintenance, and repair services ("Services") to residential and commercial waterfront properties in Georgetown, Maryland and surrounding Chesapeake Bay communities.

These Terms of Service ("Terms") establish a binding agreement between you ("Client," "you," or "your") and the Company. By requesting a consultation, accepting a project estimate, or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you should not use our Services. The Company reserves the right to modify these Terms at any time. Continued use of our Services following any modifications constitutes your acceptance of the updated Terms.

2. Scope of Services

Our Services include, but are not limited to:

  • Site assessment and evaluation of dock conditions, water depth, and vessel specifications
  • Professional design and engineering of boat lift systems tailored to your waterfront
  • Installation of boat lift hardware, motors, cables, pulleys, and electrical components
  • Alignment, calibration, and safety testing of installed lift systems
  • Client training and operational guidance
  • Inspection, maintenance, and repair services as agreed upon

Any Services not explicitly listed in your signed project proposal or estimate are not included in the scope of work and may be subject to additional charges.

3. Estimates, Proposals & Payment Terms

Estimates

All written estimates are valid for 30 days from the date of issue. Estimates are based on information provided during the site visit and are subject to verification upon project commencement. Additional charges may apply if site conditions differ materially from the initial assessment.

Payment Schedule

Payment terms are as follows unless otherwise agreed in writing:

  • 50% deposit upon project approval and scheduling
  • 50% balance due upon project completion and final inspection

All invoices are due within 30 days of receipt. Late payments may accrue interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is less.

Accepted Payment Methods

We accept cash, check, credit card, and electronic bank transfers. A 3% processing fee applies to credit card payments.

4. Warranty Information

Installation Warranty

The Company warrants that all installation work will be performed in a professional and workmanlike manner in accordance with industry standards and manufacturer specifications. We provide a 12-month warranty on all installation labor and workmanship from the date of project completion.

Equipment Warranty

Boat lift equipment, motors, cables, and electrical components are warranted by their respective manufacturers. The Company will facilitate warranty claims on your behalf, but the manufacturer's warranty terms and conditions apply. The Company is not responsible for defects in materials or equipment manufacturing.

Warranty Limitations

This warranty does not cover:

  • Damage resulting from improper operation, maintenance, or storage
  • Damage from weather events, ice damage, or natural disasters
  • Modifications or repairs performed by third parties
  • Rust, corrosion, or deterioration from environmental exposure
  • Damage to your boat or other property
  • Routine maintenance or wear and tear

To activate warranty coverage, you must maintain the lift system according to manufacturer guidelines and schedule recommended maintenance inspections.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Company's total liability for any claim arising from these Terms or your use of our Services shall not exceed the total amount paid by you to the Company for the Services in question.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

The Company is not responsible for:

  • Damage to your boat, dock, or other property
  • Injury to persons or animals
  • Environmental damage or pollution
  • Disruption to marina operations or neighboring properties
  • Delays caused by weather, permitting issues, or supply chain interruptions
  • Costs associated with site remediation or environmental cleanup

6. Cancellation & Project Changes

Cancellation by Client

If you cancel a scheduled installation project:

  • More than 30 days before the scheduled start date: Full refund of deposit minus 10% administrative fee
  • 15–30 days before the scheduled start date: 50% of deposit refunded
  • Less than 15 days before the scheduled start date: No refund of deposit

Project Changes

Any changes to the scope of work, materials, or timeline must be approved in writing by both parties. Change orders will be issued detailing the modification, associated costs, and revised timeline. Work will not proceed on changes until a signed change order is received and any additional fees are paid.

Cancellation by Company

The Company reserves the right to cancel a project if: (1) site conditions are unsafe or inaccessible; (2) client fails to provide required access or cooperation; (3) client fails to pay invoices as due; or (4) unforeseen circumstances make completion impossible or unsafe. In such cases, you will receive a full refund of any payments made.

7. Client Responsibilities & Site Access

As a client, you agree to:

  • Provide safe and unobstructed access to your dock and waterfront property during scheduled work hours
  • Ensure that all necessary permits and approvals are obtained prior to installation
  • Disclose any known hazards, environmental concerns, or structural issues with your dock or pilings
  • Verify that your boat and property are adequately insured
  • Follow all safety guidelines and instructions provided by Company personnel
  • Maintain the lift system according to manufacturer recommendations and maintenance schedules
  • Notify the Company immediately of any malfunctions, unusual noises, or safety concerns

8. Insurance & Risk of Loss

You are responsible for maintaining comprehensive insurance coverage on your boat, dock, and property. The Company maintains general liability insurance but does not provide coverage for your vessel or property.

Risk of loss or damage to your boat transfers to you upon the completion of installation and your acceptance of the lift system. The Company is not responsible for damage to your boat during or after installation, including but not limited to scratches, dents, or structural damage.

The Company will exercise reasonable care to protect your property during installation, but cannot guarantee that no damage will occur. Any damage observed during installation will be documented and reported to you immediately.

9. Intellectual Property Rights

All designs, engineering drawings, specifications, and technical documentation created by the Company for your project are the exclusive property of the Company. You are granted a limited license to use these materials solely for the purposes of operating and maintaining your boat lift system.

You may not reproduce, distribute, or share these materials with third parties without the Company's written consent. Any custom modifications or adaptations designed specifically for your dock remain the Company's intellectual property.

The Company may use anonymized photos or descriptions of completed projects for marketing and portfolio purposes unless you request otherwise in writing.

10. Permits & Regulatory Compliance

The Company will provide guidance on local, state, and federal permitting requirements but does not obtain permits on your behalf. You are responsible for:

  • Obtaining all required permits from the Town of Georgetown, Maryland Department of the Environment, and any other applicable authorities
  • Ensuring compliance with wetlands regulations, coastal zone management rules, and environmental protection standards
  • Paying all permit fees and associated costs
  • Providing copies of approved permits before installation begins

The Company reserves the right to halt work if required permits are not provided or if we determine that work cannot proceed in compliance with applicable regulations.

11. Maintenance & Service Obligations

Upon completion of installation, you assume full responsibility for the maintenance and operation of the boat lift system. Failure to maintain the lift according to manufacturer guidelines and our recommendations may void the warranty and result in system failures or safety hazards.

Recommended maintenance includes:

  • Regular visual inspection of cables, pulleys, and electrical connections
  • Lubrication of moving parts as specified by the manufacturer
  • Professional inspection at least annually or as recommended
  • Seasonal preparation for harsh weather or ice conditions
  • Prompt repair of any malfunctions or safety issues

12. Confidentiality & Privacy

The Company respects your privacy and maintains the confidentiality of all personal and property information provided during the course of our relationship. We will not share your information with third parties except as required by law or with your explicit consent.

Information collected includes your name, contact details, property address, boat specifications, and payment information. This information is used solely for providing Services, communicating project updates, and maintaining records.

We may use anonymized project data and before/after photos for portfolio and marketing purposes unless you request otherwise in writing.

13. Dispute Resolution & Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.

Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation and discussion. If negotiation fails, disputes may be submitted to mediation before pursuing litigation.

Any legal action or proceeding arising from these Terms must be brought exclusively in the state or federal courts located in Kent County, Maryland, and both parties consent to the jurisdiction and venue of such courts.

14. Safety & Assumption of Risk

Operating a boat lift involves inherent risks, including but not limited to mechanical failure, electrical hazards, and water-related dangers. You acknowledge these risks and assume full responsibility for the safe operation of the lift system.

You agree to:

  • Follow all safety instructions provided during training
  • Never operate the lift if you are unsure of proper procedures
  • Keep children and unauthorized persons away from the lift during operation
  • Inspect the lift before each use for visible damage or malfunction
  • Immediately cease operation and contact the Company if any safety concerns arise

The Company will provide comprehensive training on lift operation and safety procedures. Failure to follow these procedures may result in injury or property damage for which the Company is not liable.

15. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including attorney's fees) arising from or related to:

  • Your use or operation of the boat lift system
  • Injury to persons or damage to property caused by your boat or lift
  • Your violation of these Terms or applicable laws
  • Your failure to maintain or properly operate the lift
  • Claims by third parties related to your property or boat

This indemnification obligation does not apply to claims arising solely from the Company's gross negligence or willful misconduct.

16. Severability & Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, shall be severed. The remaining provisions shall remain in full force and effect.

These Terms, together with any signed project proposal, estimate, or change order, constitute the entire agreement between you and the Company regarding the Services. Any prior negotiations, representations, or agreements not expressly set forth in writing are superseded and of no effect.

18. Acknowledgment & Acceptance

By signing a project proposal, paying a deposit, or commencing Services, you acknowledge that:

  • You have read and fully understand these Terms of Service
  • You agree to be bound by all provisions contained herein
  • You have had the opportunity to ask questions and seek legal counsel
  • You accept all risks associated with boat lift installation and operation
  • You understand the limitations of liability and warranty coverage
